New Data Show Interior Enforcement in Freefall

Data released last week by the Department of Homeland Security’s (DHS) Bureau of Immigration and Customs Enforcement (ICE) have affirmed that the Obama Administration has practically abandoned meaningful worksite enforcement. Compiled by House Judiciary Committee Ranking Member Lamar Smith (R-TX), the statistics show “dramatic reductions in criminal arrests, criminal indictments, criminal convictions and administrative arrests of illegal immigrant workers from [Fiscal Year (FY)] 2008 to FY 2009.”

House Judiciary Republicans Hold Immigration Forum on Capitol Hill

On Thursday, November 19, Republican Members of the House Judiciary Committee held a forum entitled “American Jobs in Peril: The Impact of Uncontrolled Immigration.” The forum allowed several experts to offer testimony regarding the negative consequences that unrestricted mass immigration both legal and illegal has had on American workers.

Massachusetts Governor Pushes for Driver’s Licenses and Tuition Breaks for Illegal Aliens

Last week Governor Deval Patrick unveiled a state-commissioned report that recommends driver’s licenses and in-state tuition for illegal aliens in Massachusetts. The 56-page report, known as the New Americans Agenda, includes 131 recommendations for integrating immigrants into economic and civic life in Massachusetts. However, the Agenda is not limited to helping immigrants who cross our borders legally, but specifically advocates for measures that will benefit illegal aliens and undermine our immigration laws.

Illegal Aliens Moving to Texas in Wake of Tough Oklahoma Law

A Texas-based television station reported last week that experts believe that as many as one million illegal aliens have moved to Texas from neighboring states as those states “toughen up on immigration.”

“Bi-lingual teachers are hired to accommodate non-English speaking students. That means additional equipment, classrooms, and cost of hiring a special teacher. When integrated into existing classrooms, illegals take away individual teaching time from all the other students. This means higher taxes for Americans, over crowding in our schools, and an additional burden for our schools, hospitals, and less jobs in a recession for Americans.”

House Leadership Sides with Congressional Hispanic Caucus on Health Care Bill, Passes Bill With Illegal Alien Coverage Loophole

Last week, the latest House health care bill (H.R. 3962) raised a number of concerns over the direction the bill was taking with respect to immigration policy. Earlier this summer, FAIR had raised concerns over the language of the bill with respect to Section 342(d), which would waive the current 5-year waiting period before legal aliens can access the affordability credits under the bill. FAIR also led the national debate over the loopholes that existed in the earlier House bill, H.R. 3200, that would allow illegal aliens to access the benefits under the bill.

Senate Democrats Block Vitter/Bennett Census Amendment

On Thursday, November 5, all 60 Senate Democrats voted to shut off debate on the Fiscal Year 2010 spending bill for the Departments of Commerce, Justice and certain federal science programs. This vote effectively blocked the Senate from voting on an amendment offered by Senators David Vitter (R-LA) and Robert Bennett (R-UT) that sought to require the Census Bureau to include questions about citizenship and immigration status in next year’s decennial census.

Vulnerable Democrats Tell Leadership to Avoid Amnesty in 2010

On Wednesday, November 4, The Hill ran an article indicating that moderate Congressional Democrats who may be vulnerable in the upcoming 2010 midterm elections “want their leaders to skip the party’s controversial legislative agenda for next year to help save their seats in Congress.” The Hill noted that these vulnerable Democrats “don’t want to be forced to vote on…immigration reform…which they say should be set aside so Congress can focus on jobs and the economy.”  These comments all reflect the feelings of the American people who, with the national unemployment rate now above ten percent for the first time in 26 years, are adamantly opposed to “comprehensive immigration reform” Democratic Leadership’s euphemism for granting amnesty to millions of illegal aliens.

True Immigration Reformers Win Statewide Elections in Virginia

On Tuesday, November 3, a group of three true immigration reformers won statewide races for public office in the state of Virginia. While immigration was not a major factor in any of these races, the three candidates who won on Tuesday have staked out pro-enforcement positions on several immigration-related issues.

Latest House Health Care Bill Contains Verification Process that Raises Concerns Last Thursday, Speaker Nancy Pelosi (D-CA) introduced the latest version of the House health care bill, The Affordable Health Care for America Act (H.R. 3962). FAIR had raised concerns about a previous version of this bill (H.R. 3200) due to its lack of a verification mechanism to ensure that illegal aliens would be unable to obtain taxpayer-funded health care benefits under the bill.Read the full article

Sen. Reid Blocks Sen. Sessions’ E-Verify Amendment to Unemployment Extension Bill This past week, undeterred by Congress’ previous failure to permanently extend E-Verify, Senator Jeff Sessions (R-AL) again took to the Senate floor to fight for American workers and to protect American jobs. When the Senate took up a bill to extend federal unemployment benefits for 14 weeks, Senator Sessions filed an amendment to permanently extend the E-Verify program — the online, electronically operated system that allows employers to quickly and easily confirm that their new hires are legally authorized to work in the United States and not illegal aliens. The Sessions amendment will ensure that available jobs would go to American citizens and legal immigrants.Read the full article

Federal Contractor Says E-Verify Helps With Hiring Process On Tuesday, October 27, the Union-Tribune in San Diego reported that a major federal contractor has found that E-Verify — the online, electronically operated employee verification system — actually helps with the hiring process. These comments came less than two months after the Obama Administration implemented a federal regulation requiring most federal contractors to use E-Verify. The comments raise questions about the allegations that amnesty-advocating, big business special interest groups have levied against E-Verify.Read the full article

Congressional Letters Push Administration on 287(g), Amnesty Last week, two different groups of Members of the House of Representatives sent two separate letters to President Obama. On October 26, a bipartisan group of 54 Representatives sent the president a letter expressing their support for 287(g) — the federal program that allows officials from the Department of Homeland Security’s (DHS) Bureau of Immigration and Customs Enforcement (ICE) to train state and local law enforcement agencies in the enforcement of federal immigration laws. Also last week, a group of “House Democrats signed a letter reminding President Obama of his administration’s commitment” to grant amnesty to the approximately 12 million illegal aliens living in the United States.Read the full article

Including Illegal Aliens in 2010 Census Raises Serious Constitutional & Voting Rights Issues

Last week’s Legislative Update provided details about an amendment filed by Senator David Vitter to the Fiscal Year (FY) 2010 Commerce, Justice, Science (CJS) appropriations bill. The Vitter amendment would require the Census Bureau to ask questions about citizenship and immigration status as part of the 2010 decennial census.

Investigation Reveals ICE Monitoring Programs are Ineffective Immigrant Detention Alternatives

On Tuesday, October 20, the Houston Chronicle released a report based on records obtained from the Department of Homeland Security’s (DHS) Bureau of Immigration and Customs Enforcement (ICE). The report revealed that, during the past five years, nearly 20 percent of suspected illegal aliens who went through ICE’s “Intensive Supervision Appearance Program” (“ISAP”) failed to appear for their day in immigration court, and that “private contractors that administer ISAP…were ‘unable to locate’” these aliens.

With Unemployment Near Ten Percent, Giffords Seeks Importation of More Cheap Foreign Labor

FAIR has learned that with unemployment at its highest rate in more than 25 years Congresswoman Gabrielle Giffords (D-AZ) is prepared to introduce legislation that would double the number of visas available annually for foreign workers under the H-1B visa program. The H-1B visa program allows employers to bring foreign workers to the United States to work in specialty occupations that require “the theoretical and practical application of a body of specialized knowledge and a bachelor’s degree or the equivalent in the specific specialty.”

Congressman Gutierrez Outlines “Core Principles” of an Amnesty Bill

On Tuesday, October 13, Congressman Luis Gutierrez (D-IL) released the “core principles” of the amnesty bill he is planning to introduce in Congress later this year. The bill will be similar to other pieces of amnesty legislation from previous sessions of Congress, including (1) several different amnesty programs aimed at legalizing the 12 million illegal aliens currently living in the United States and (2) empty promises of enforcement.

White House Uses Federal Funds to Steer Volunteers to Pro-Amnesty Groups

As President Obama teamed up last week with former President George H.W. Bush to encourage Americans to perform more community service, FAIR’s staff has discovered that a search for “immigration” volunteer opportunities on the administration’s Serve.gov website which describes itself as “your online resource for not only finding volunteer opportunities in your community, but also creating your own” (About Serve.gov) has a distinct bias in favor of organizations that support amnesty.Read the full article

Amendment to Require Citizenship and Immigration Questions as Part of Census on Hold in Senate

When the Senate began debate on the annual 2010 funding for the departments of Commerce, Justice and certain science programs on October 7, 2009, Senators David Vitter (R-LA) and Robert Bennett (R-Utah) filed an amendment to the “CJS” bill that would have required the Census Bureau, which is part of the Department of Commerce, to include on the census forms questions related to citizenship and immigration status. Congress Kills Permanent Extension of E-Verify

On Tuesday, October 7, the House and Senate conferees for the Homeland Security appropriations bill finalized the details of the conference report. According to a document prepared jointly by the House Appropriations Committee and the Senate Appropriations Committee, the conferees turned back the opportunity to permanently extend the E-Verify program and instead included only a three-year extension of the program.

DHS Weakens Immigration Detention System

On Tuesday, October 6, Department of Homeland Security (DHS) Secretary Janet Napolitano and U.S. Immigration and Customs Enforcement (ICE) Assistant Secretary John Morton announced a series of new initiatives aimed at reforming the system the federal government utilizes to detain deportable aliens. Several of these initiatives have raised troubling issues in the eyes of true immigration reformers and may actually undermine the enforcement of federal immigration laws.

Senate Rejects Immigration Amendments to Bill that Funds the Census Bureau and DOJ

Last week, the Senate rejected two amendments related to immigration during debate over the Commerce-Justice-Science appropriations bill for Fiscal Year 2010, which funds agencies like the Census Bureau, which is part of the Commerce Department, and the Department of Justice which administers the Community Oriented Policing Services (“COPS”) program that is a grant program to state and local law enforcement agencies.

ICE Forces Sheriff Joe to Sign Weakened 287(g) Agreement

Last week, multiple media reports revealed that the Department of Homeland Security’s (DHS) Bureau of Immigration and Customs Enforcement (ICE) has forced Maricopa County, Arizona Sheriff Joe Arpaio to sign a weakened 287(g) agreement.  287(g) is the federal program that allows ICE to train state and local law enforcement agencies in the enforcement of federal immigration laws. The weakened 287(g) agreement that Sheriff Joe was forced to sign reflects changes to the program that the Obama Administration originally announced in July.

Senators Question Napolitano on Possible Reduction of Border Patrol Agents

On Tuesday, October 6, Senators Chuck Grassley (R-IA); Orrin Hatch (R-UT); John Cornyn (R-TX); Jon Kyl (R-AZ); Tom Coburn (R-OK); Jeff Sessions (R-AL); John McCain (R-AZ); and Kay Bailey Hutchison (R-TX) sent a letter to Homeland Security (DHS) Secretary Janet Napolitano, questioning her about media reports indicating that her department was considering decreasing the number of Border Patrol agents stationed along the U.S.-Mexico border in Fiscal Year (FY) 2010. The senators asked Napolitano to confirm that DHS will either maintain or increase Border Patrol manpower along the southwest border in FY2010.

DHS Fails to Make Border Security a Priority

Last week — Thursday, October 1 — marked the beginning of Fiscal Year (FY) 2010. For each Fiscal Year, the Department of Homeland Security (DHS) sets goals with respect to the number of border miles it hopes to have under “effective control” during that Fiscal Year. According to DHS, the department had 894 of the 8,607 miles of the border for which it is responsible under “effective control” as of May 31, 2009. Recent media reports, however, have indicated that DHS officials are planning to set the goal for FY2010 at 894 miles. In effect, DHS has admitted that it does not intend to bring even one more mile of our porous border within “effective control” over the course of the next Fiscal Year.

Senate Finance Committee Rejects Verification, Other Immigration-Related Amendments

Last week, the Senate Finance Committee wrapped up its consideration, or “mark up,” of its health care reform bill, the America’s Healthy Future Act of 2009. During the mark up, the committee rejected two amendments that sought to enhance verification requirements for individuals who apply for taxpayer-subsidized health care benefits, as well as another amendment regarding federal benefits for legal aliens.

Despite Rising Unemployment, DHS Prepares for Amnesty

On Friday, October 2, the director of the Department of Homeland Security’s (DHS) Bureau of Citizenship and Immigration Services (USCIS), Alejandro Mayorkas, told The New York Times that his agency is “under way to prepare for” the possibility of giving legal status to millions of amnestied illegal aliens. Mayorkas’ comments came on the same day that the Bureau of Labor Statistics announced that the nationwide unemployment rate has jumped to a 26-year high of 9.8 percent.

Immigration Amendments to Senate Finance Committee Health Bill Could See Action this Week

Last week, FAIR’s Legislative Update provided details about the health care reform bill released by Senator Max Baucus (D-MT), who chairs the Senate Finance Committee. (FAIR’s Legislative Update, September 21, 2009). We noted that the “chairman’s mark” was conceptual in nature and did not contain enough detail to understand how the eligibility verification provisions to ensure illegal aliens do not receive health care benefits would actually work. The Congressional Budget Office this week issued a letter to Senate Finance Committee Ranking Member Charles Grassley (R-IA) confirming our analysis.

Congress Set to Pass Short-Term Funding Resolution, Including 31-day E-Verify Extension

Last Thursday, the House and Senate conferees for the Fiscal Year 2010 Legislative Branch appropriations bill agreed to the conference report for the $4.65 billion bill. Spending for the current Fiscal Year was set to expire on September 30, 2009, but the conference report also includes a 31-day extension — or “continuing resolution” (CR) of all federal spending programs to avoid a government shutdown.

Rep. Gutierrez to Introduce Amnesty Bill

On Thursday, September 17, Representative Luis Gutierrez (D-IL) announced that he will “outline the fundamental principles of” an amnesty bill by October 13 and introduce actual legislation “shortly thereafter.” Gutierrez announced his intent to push amnesty legislation at a rally attended by special interest, open border advocacy groups, and noted that his bill will include “a pathway to legalization for those who have earned it.”

True Immigration Reformers Score Victory in House

IRS to Send Tax Refunds to Deported Aliens; School District Asks Students for Proof of Residency

Two reports last week dealing with benefits for illegal aliens highlighted just how out of touch the federal government has become in the immigration debate. On the federal level, “[a] partnership between a Pennsylvania accounting firm and a Mexican human rights group [is aiming] to seek out Mexicans recently deported from the United States and offer to help them file for thousands of dollars in tax refunds.” On the local level, however, a school district superintendent in a Texas border town is asking students to prove that they are residents of the school district before they can attend school.

White House Endorses Closing Illegal Alien Health Care Loophole, Outrages Open Borders Lobby

Last week, Finance Committee Chairman, Senator Max Baucus (D-MT) released a thumbnail sketch of the Senate health care bill.  While this document is merely a detailed outline, and the specifics have yet to be finalized, the Baucus outline does reference eligibility verification to prevent illegal aliens from accessing benefits, including the Senate bill’s tax credits to help pay for health insurance.  (See Chairman’s Mark).

Just three days after Rep. Joe Wilson’s (R-SC) response to President Obama’s address before Congress, the Obama Administration indicated “that verification of immigration status would be required for anyone seeking to purchase coverage” under their health care reform proposal. (The New York Times, September 11, 2009).  Five days later, Senator Max Baucus (D-MT) released a sketch of his proposal.  The position taken by President Obama and Senator Baucus last week with respect to taxpayer-funded benefits for illegal aliens is not materially different than the public position they took from May to July.  (See CBSNews, July 21, 2009; Topix, July 27, 2009; Houston Chronicle, May 21, 2009).  Accordingly, the public statements made by the President and Senator Baucus beginning in May and again last week, that illegal aliens will not receive benefits, have remained consistent.  Despite this consistency, the Baucus document, coupled with the Obama Administration’s announcement prompted outcry from open-borders lobbyists late last week.

The Baucus’ outline prompted well known anti-enforcement, open borders advocates to criticize the plan because of its inclusion of an immigration status verification requirement.  Frank Sharry, Executive Director of the pro-amnesty group America’s Voice, stated: “Quite frankly, it seems now that the politics of health care reform is to dump on immigrants even if it means bad policy.” Luis Cortés, chief executive officer of Esperanza USA, argued that the inclusion of the verification requirement indicated “that the U.S. Congress is losing its moral barometer.” (Congress Daily, September 16, 2009).  Furthermore, the National Council of La Raza (NCLR) has scheduled a “national call on the state of health care reform” to discuss what people “can do to ensure that health care reform is inclusive of all communities and that the President and Congress do not throw Latinos and immigrants under the bus.” (NCLR).

These recent outbursts by the open-borders lobby has prompted true immigration reformers to wonder why — if the provisions of the House bill, including Section 246 which said “Nothing in this bill…shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States,” was effective — were America’s Voice and LaRaza so quiet about this issue in May and when the House bill was introduced in July?  (See FAIR’s House Health Care Bill Analysis).  The answer, of course, is obvious.  The silence from the open-borders lobby proves how truly ineffective Section 246 would have been.  The fact that these groups are so vocal today proves that the President’s statements and the Senate outline represent a giant leap forward towards the inclusion of meaningful eligibility verification to prevent illegal aliens from accessing health benefits.  While true immigration reformers still have a long way to go to realize meaningful eligibility verification, there is no doubt that the voices of the American people are finally being heard on this issue.  (To understand how FAIR and the American people made their voices heard, see FAIR’s Legislative Update, August 17, 2009 and August 24, 2009).

It is also worth noting that the anti-enforcement lobby’s opposition to any immigration status verification in a health care reform proposal is completely out-of-touch with the views of the average American and clearly outside the mainstream of public opinion. According to Rasmussen Reports, an overwhelming 83% of U.S. voters “say that people should be required to prove they are a citizen of the United States before receiving government health care subsidies.” (Rasmussen Reports, September 7, 2009). This may be because Americans understand the exorbitant health care-related costs that illegal aliens impose on American taxpayers.  For example, a media report revealed earlier this month that taxpayers in California “contribute more than $1 billion annually to cover the health care costs of illegal residents.” (The Contra Cost Times, September 11, 2009).

Senate Health Reform Plan Released This Week

Last week, Senator Max Baucus (D-MT), who chairs the Senate Finance Committee, released a detailed outline of his committee’s health care bill.  (See Chairman’s Mark).  Baucus’ document is a “conceptual” draft and does not yet contain sufficient detail for FAIR to determine the specific details of the eligibility verification provisions in the outline and to determine whether they would prove effective to actually prevent illegal aliens from accessing benefits under the bill.

While the details still have to be completed, FAIR is initially encouraged that verification is part of the plan in the Senate.  (See page 21 of the Chairman’s Mark).  This represents a significant improvement over the House bill (H.R. 3200) which lacked eligibility verification altogether.  These initial details were also sufficient to prompt Senator Robert Menendez (D-NJ), an ardent amnesty supporter and member of the Senate Finance Committee, to threaten to kill the bill when it is considered by the Finance Committee.  (See The Hill, September 18, 2009).

According to The Hill, Menendez “is putting Democrats in a bind by seeking to let illegal immigrants benefit from the healthcare overhaul.” (Id.). While Democrats enjoy a 13-10 advantage on the Committee, the fact that Menendez’ fellow Democrat committee member, Senator Jay Rockefeller (D-WV), has said he will oppose the bill, means that Senator Menendez has become the swing vote for the committee to be able to vote out a bill. Accordingly, Menendez is now putting himself at odds with President Obama and 83 percent of the American people who support eligibility verification.

As details become available concerning the bill’s language, FAIR will keep true immigration reformers up to date.

2009 Hold Their Feet to the Fire a Resounding Success

Last week, September 15 and 16, FAIR held its annual Hold Their Feet to the Fire event in Washington, D.C. 45 of America’s finest radio talk show hosts broadcast their shows live from radio row, reaching listeners in all 48 of the contiguous states. In addition, the event brought hundreds of activists from across the country to the nation’s capital to lobby Congress in support of true immigration reform.

New Report Shows Schools Increasingly Hiring Foreign Teachers Over Americans

A report released last week by the American Federation of Teachers (AFT) entitled “Importing Educators: Causes and Consequences of International Teacher Recruitment” has revealed that “some American school districts have turned increasingly to overseas recruiting to find teachers” to fill teaching vacancies. The findings in the new report raise questions regarding proper levels of legal immigration and, in particular, the H-1B visa program. (AFT Report; The New York Times, September 15, 2009).

According to the report, nearly 20,000 teachers were working in the United States on temporary visas in 2007, and that number is increasing steadily. The report contains a case study of the Baltimore Public School District and notes that the city had hired 108 teachers from the Philippines in 2005. Just two years later, more than 600 Filipino teachers are now working in Baltimore classrooms, comprising more than 10% of the district’s teaching workforce. The report went on to assert that Baltimore school officials were leaning so heavily on these foreign teachers to fill job vacancies in their district that they were recruiting less aggressively in the United States: “Rather than attending job fairs throughout the Mid-Atlantic, trying to persuade reluctant American teachers to accept positions in troubled inner-city schools, HR officials can meet all their hiring needs in one trip. At a single career fair in Manila, they can interview hundreds of pre-screened applicants, each of whom is eager to pay for the opportunity to work in Baltimore city schools.” (Id.).

The AFT’s findings imply that international teacher recruitment is displacing American teachers. Amid the current economic recession, declining tax revenues have forced many state and local governments to lay off teachers. (The Wall Street Journal, February 3, 2009). Why, then, are school districts across the country increasingly recruiting foreign teachers to come to the United States to fill teaching vacancies? The AFT report suggests a possible answer: in one school district, foreign born teachers were “paid only $18,000 per teacher for their services, well below prevailing wage.” (AFT Report).

The AFT report also points out that many foreign teachers are being brought to the United States on H-1B visas. The H-1B visa program allows employers to bring foreign workers to the United States to work in specialty occupations that require “the theoretical and practical application of a body of specialized knowledge and a bachelor’s degree or the equivalent in the specific specialty.” (Department of Labor). However, some — most notably Bill Gates of Microsoft — have put forth the misconception that the H-1B program exists primarily to bring foreign workers to the United States to work in technology-related fields. Gates has then leveraged this misconception to lobby Congress to increase the H-1B visa cap so that companies such as Microsoft can have access to more cheap foreign labor.
