Help FAIR Ensure That Illegal Aliens

Won’t Be Able to Access Taxpayer-Funded Benefits!

The Senate is currently considering the health care reform bill (H.R. 3590).  As FAIR’s Legislative Analysis concludes:

  1. The Senate bill contains a loophole to allow illegal aliens to access taxpayer-funded health care benefits;
  2. The Senate bill fails to effectively prevent illegal aliens from accessing the taxpayer-subsidized “exchange” marketplace; and
  3. In a radical departure from current law, the Senate bill circumvents long-standing policies that would require legal immigrants to wait five years before accessing federal health care benefits.

As a result, the Senate health care bill promotes poor immigration policy and fails to protect the interests of the American taxpayers.

In addition, the Senate bill raises a new issue. Under the bill, low-income American citizens – those with income below 100% of federal poverty (FPL) – have only one option for their health insurance: Medicaid.  At the same time, the bill gives similarly-situated legal aliens more health care choices than the American citizen. Legal aliens can receive the taxpayer-subsidy to choose whatever health insurance they want.  This is fundamentally unfair.  It treats immigrants better than American citizens.

But despite these issues, the Senate has not debated these provisions on the Senate floor.  Fortunately, these problems and inequities can still be fixed.

FAIR has been working with two true immigration reformers in the Senate who intend to offer amendments to fix these problems.

Senator Jeff Sessions (R-AL) will file an amendment that would:

  • Require the use of a meaningful and effective verification system to ensure that illegal aliens will not be able to access taxpayer-funded tax subsidies created by the bill;
  • Prevent illegal aliens from accessing the taxpayer-funded exchange to buy insurance; and
  • Maintain the 5-year waiting period in current law so that immigrants must pay into the system before they are able to receive taxpayer-funded health benefits.  The 5-year waiting period is critical because it embodies the principle that immigrants should not become a public charge – or burden – to the American people.

In addition, Senator John Ensign (R-NV) has filed an amendment (Amdt. No. 3016) to ensure that American citizens would have the same choices for their health care as the bill gives legal immigrants.  This will guarantee citizens are not treated unfairly.

These Senators need our help to ensure that:

  • Senate leadership will allow debate on these critical amendments; and
  • That each of these critical amendments will get a vote on the Senate floor.

  • I support the Ensign amendment (No. 3016).  Low-income Americans deserve the same freedom and flexibility regarding their health care choices as the Senate bill gives legal immigrants.
  • I oppose any effort to shut off debate over these issues, and oppose any effort to end debate on the bill, until the amendments get the up-or-down vote they deserve!

White House to Begin Push on Immigration Overhaul in 2010

The Obama administration will insist on measures to give legal status to an estimated 12 million illegal immigrants as it pushes early next year for legislation to overhaul the immigration system, Homeland Security Secretary Janet Napolitano said on Friday.

In an address at the Center for American Progress, a liberal policy group in Washington, Ms. Napolitano sought to dispel any notion that the administration — with health care, energy and other major issues crowding its agenda — might postpone the most contentious piece of an immigration overhaul until after midterm elections next November.

Laying out the administration’s bottom line, she said it will argue for a “three-legged stool” that includes enacting tougher enforcement laws against illegal immigrants and the people who hire them, and streamlining the system for legal immigration, but also what she called a “tough and fair pathway to earned legal status.”

With unemployment surging over 10 percent and Congress wrestling with health care, advocates on all sides of the immigration debate had started to doubt that President Obama would keep to his pledge to take on the divisive issue of illegal immigration in the first months of 2010.

Congress should be ready to move forward on immigration, Ms. Napolitano said, because the administration had made a “fundamental change” in security at the border and in cracking down on employers hiring illegal immigrants. She said that the Border Patrol had increased its forces by more than 20,000 officers, and that more than 600 miles of border fence had been completed, both milestones set by Congress.

“Let me emphasize this,” she said. “We will never have fully effective law enforcement or national security as long as so many millions remain in the shadows.”

Under the administration’s plan, illegal immigrants would have to register, pay fines and all taxes they owe, pass a criminal background check and learn English.

Ms. Napolitano has been leading the administration’s efforts to gather support for the immigration overhaul, meeting in recent weeks with business leaders, faith groups, law-enforcement officials and other groups to gauge their support for the effort.

“Fundamental Change”?

OK everybody, say it with me on the count of three.

BULL-SHIT!

First of all, anyone who’s ventured out of their house in the last couple of years knows that there has been virtually zero enforcement of immigration laws of any sort, anywhere in our country. Not in the workplace, not in federal, state or local social services, not in our prisons. NOWHERE.

Yes, there’s the occasional high-profile raid on some poultry processing plant somewhere, but one is as meaningless as the next. Most often, those swept up in raids are simply released within a day or two with a promise to show up in court which, of course, they never do.

The only change whatsoever I’ve noticed is that the illegals don’t seem to be the least bit worried about being caught anymore.

For Napolitano to stand there and assert that all this ‘progress’ in terms of enforcement has been made is way, way beyond dishonest, it’s….I don’t know, surreal is the only word I can come up with.

Second, this bit about  a “tough and fair pathway to earned legal status.” Really? Fair for whom? Certainly not for the 16 million or so Americans who can’t find jobs. Not for the immigrants who have come here legally, embraced the American way, and did the hard work to earn their citizenship. Certainly not for those who, rather than jumping a border fence and living off the stolen social security numbers and taxpayer-funded social services of  legal United States residents, are patiently waiting their turn for a chance of legitimately becoming part of the greatest society in the world.

Here’s a  clue, Janet - If it doesn’t involve first going to the back of the line - which, btw, is IN MEXICO, than it’s not “tough and fair”.

If nothing else, this woman’s got balls. (no pun intended).

The country is currently dealing with over 10% unemployment, our fiscal situation is dire and getting worse, and the Obama administration wants to flood the labor market with MORE workers, and flood the social services systems with MORE recipients. All while putting us in jail for not having health insurance. This is absolute, 100% complete unadulterated fucking madness.

There’s been talk lately that healthcare legislation is this administration’s and the liberal left’s ‘crown jewel’, but I would suggest that amnesty is the real crown jewel, because it is amnesty for 20 million (the 11 mil figure is grossly underestimated), PLUS an additional 20-40 million in chain migration, that will give the Democrats the numbers they need to establish their permanent majority, and therefore the numbers needed to enact the rest of their nation-killing, Constitution-shredding socialist agenda. Healthcare is big, but gaining 20+ million votes is HUGE. With that many votes, they can and will do whatever they damn well please.

This must be stopped, or America as we know it - as the greatest nation on the face of the earth - is over. O-V-E-R.

They think healthcare fight is tough? They have no idea what they’re in for.

Obama: Legalize illegals to get them health care

From Washington Times (via Gateway Pundit):

President Obama said this week that his health care plan won’t cover illegal immigrants, but argued that’s all the more reason to legalize them and ensure they eventually do get coverage.

He also staked out a position that anyone in the country legally should be covered - a major break with the 1996 welfare reform bill, which limited most federal public assistance programs only to citizens and longtime immigrants.

“Even though I do not believe we can extend coverage to those who are here illegally, I also don’t simply believe we can simply ignore the fact that our immigration system is broken,” Mr. Obama said Wednesday evening in a speech to the Congressional Hispanic Caucus Institute. “That’s why I strongly support making sure folks who are here legally have access to affordable, quality health insurance under this plan, just like everybody else.

Mr. Obama added, “If anything, this debate underscores the necessity of passing comprehensive immigration reform and resolving the issue of 12 million undocumented people living and working in this country once and for all.”

…and here we go. Let’s not worry about the economy, let’s not worry about the intentionally-caused and rapidly widening racial divide that alone threatens to tear us apart, let’s not worry about stabilizing any aspect of our country’s precarious condition.

No, let’s instead just throw open the borders and finish things off once and for all.

Barack Obama and the democrats will stop at nothing to see our country destroyed before his first term is up. The healthcare fight will seem easy compared to the struggle that still lies in front of us.

The Moral Bankruptcy Of The Far Left

A thinking, feeling human being should, at their core, have some minimum level of decency, some minimum level of compassion for fellow human beings below which their God-given sense of right and wrong, good and evil, will override their everyday passions and politics; a point below which they will put aside their superficial and even deeply-held beliefs, if only just for a moment, to join with their fellow human beings to say “This Is WRONG!”.

By now, we all know about the ACORN expose by filmmakers James O’Keefe and Hanna Giles. The series of tapes they’ve released this week shows O’Keefe and Giles entering ACORN offices in DC, Baltimore, NYC, San Bernadino and now San Diego dressed as a pimp and prostitute. The premise is that they’re looking for advice and assistance in securing funds for a house in which they plan on setting up a prostitution service featuring 12-15 year-old El Salvadoran girls smuggled into the country illegally. In each and every case,  the ACORN employees were not only not shocked, but were went out of their way to assist and advise O’Keefe and Giles on subjects such as how to set up the business, hide the money, falsify tax forms, and even smuggle the underage girls into the country for the purposes of prostitution.

Even the most partisan among us should be shocked and disgusted by the ACORN employees’ willingness to facilitate and encourage the building of a child prostitution business. No matter how much we may disagree politically, this is something that should repulse us all, as well as bring universal condemnation of ACORN or anyone else who promotes or is complicit in promoting child prostitution.

So what does the ‘compassionate’ far left have to say about this?

An email dropped into my inbox this evening with a link to an article on this rather sad and pathetic anti-FOX news website (sorry, I refuse to link it here) personally attacking James O’Keefe for the job he and Hannah Giles did in exposing ACORN. Throughout the article and extending into the 20 or so comments that followed, the focus of the attack was primarily on O’Keef’s conservative political leanings, as well as some writings on his personal blog in which these losers tried to find something to ridicule. Basically, they ‘dug’, found nothing, and then attacked him anyway. Why? Because that’s what the far left does, lash out like little emotionally unstable children.

What was missing from the article and accompanying comments, however, was any sort of critical analysis of the situation, or acknowledgement - even in passing - that what the ACORN people did was wrong.

The villains, according to these people? O’Keefe. Giles. Beck. Fox. Right Wingers. Conservatives. Republicans.

Here was my response. Not holding my breath expecting it to be approved, but maybe they’ll surprise me:

These two (O’Keefe and Giles) expose an organization intent on helping facilitate child prostitution, and you have a problem with….O’Keefe and Giles?

Are you f*ing kidding me?

In truly classic liberal form, almost to a man you personally attack O’Keefe and Giles but say absolutely nothing about the real issue, which is openly criminal activity by ACORN.

My suggestion to the author of this poorly-written and entirely shameful hit piece, as well as to those passing this link around as though they’re doing the world a favor by ‘exposing’ O’Keefe and Giles: perhaps instead of creating new and increasingly unhinged ways to blame FOX News, Republicans, Glenn Beck, etc…you might instead use the time for some much-needed introspection to perhaps figure what’s gone so horribly wrong in your -own- lives to lead you to the point where you actually believe the filmmakers to be the villains in this thing.

There is something very, very wrong with your thought process.

Actually, it would be easy to take a few shots at Schultz’ staggering lack of intelligence and extreme intellectual dishonesty and leave it at that, but the fact that he and others like him can simultaneously defend ACORN while blaming everything on the republican party and conservatives only further illustrates the degree of derangement that permeates and even defines the far left. Sickening.

What about the child prostitution, ED, or is that the republicans fault too? Or maybe you’re just OK with it.

(as an aside on Bertha Lewis, the more she talks, the further she sinks the chances of even the best attorneys (not to suggest for a second that sleazeball hack moron ACORN attorney Scott Levinson has the chops to deal with any of this) to construct a case against O’Keefe and Giles that couldn’t be immediately destroyed by someone with the minimal intellectual firepower of, oh, I dunno…. a Tilly sister, perhaps.)

The far left in this country has some real problems; problems that extend well beyond a fatally flawed ideology and into what is, in my opinion, some sort of psychosis that actually allows that ideology to trump even something as vile, as morally repugnant, as undeniably evil as the forced prostitution of children.

And they wonder why their agenda is being rejected by the American people.

Politifact Gets It Wrong On Obamacare and Illegal Aliens

I got an email today from someone who, in response to a comment I made about Obamacare covering illegals, pointed me to a Politifact article, written and researched by one Angie Drobnic Holan, that tries to make the case that Obama was telling the truth when he said in last night’s health care commercial:

There are also those who claim that our reform effort will insure illegal immigrants. This, too, is false — the reforms I’m proposing would not apply to those who are here illegally.

This Politifact article is, quite frankly, ridiculous, and showcases the sort of  ‘only in the mind of a liberal’ logic that makes those of us with a modicum of intelligence and capacity to recognize the angles want to gouge our own eyes out with a spoon.

She writes:

One place where the bill does mention immigration status is for “affordability credits.” These are tax credits for people of modest means need to buy health insurance. The credits would help them buy insurance on a national health insurance exchange. The bill specifically says that people in the United States illegally are not eligible for tax credits, on page 132, section 242.

Still, given all that, we have heard from people who said that other aspects of reform could benefit illegal immigrants.

One of the most detailed responses was from the anti-immigration group Federation for American Immigration Reform, called FAIR. You can read their statement on the matter on their Web site.

The above paragraph leaves little doubt of Ms Holan’s politics. FAIR is not “anti-immigrant”, a term used almost exclusively by the open borders crowd to disparage those who understand the value of strong immigration policy and secure borders. FAIR is against ILLEGAL immigration.

Primarily, they argue that illegal immigrants would be permitted to purchase insurance on the national health insurance exchange because the bill does not include a mechanism for verifying citizenship. So illegal immigrants would have the chance to purchase insurance in the public option, a government-run health care plan that would offer basic coverage at a low price.

FAIR also argues for more robust verification measures for the affordability credit and making sure that illegal immigrant parents won’t be able to receive coverage if their citizen children are eligible.

FAIR has a point that illegal immigrants would likely be able to buy insurance on the national health insurance exchange. We don’t see anything in the bills that would hinder that. A Congressional Research Service report issued Aug. 25, 2009, confirmed our observation. The House bill “does not contain any restrictions on noncitzens participating in the Exchange — whether the noncitizens are legally or illegally present, or in the United States temporarily or permanently,” the report said.

But it’s worth pointing out that illegal immigrants participating in the exchange would be paying for their insurance like everyone else. That’s similar to the current system — we’re not aware of any particular restrictions that stop illegal immigrants from buying private insurance now. Under health care reform, illegal immigrants would be able to buy private insurance or the public option.

The Politifact writer’s logical stumblings are mind-numbing.

First, on the subject of ‘affordability credits’ (ie; taxpayer-funded insurance premium subsidies for those earning up to 400% of the federal poverty level), she writes “The bill specifically says that people in the United States illegally are not eligible for tax credits, on page 132, section 242.” , and seems to be content to take that simple statement at face value and move on.

Yet just a couple of paragraphs later, she actually agrees with FAIR’s position that the lack of citizenship verification policies in HR3200 will actually allow illegals to gain access to both the public option or the exchange.

OK then, so what’s to stop them from obtaining  the affordability credits? Absolutely nothing, because there is no verification process mandated in the bill.

(This would be a good time to remind our readers that two republican-sponsored amendments that would have required citizenship verification were voted down by the democrats.)

She then goes on to state outright “Under health care reform, illegal immigrants would be able to buy private insurance or the public option.”

OK then, so what exactly is this woman’s argument? She set out to prove that Obama did not lie, but then proceeds to make the case that illegals would indeed be covered under the proposed house bill - basically reinforcing the widely-held perception that Obama did in fact lie.

Another point worth mentioning is that even if illegals were to pay full price for their coverage under either the proposed exchange or public option, what happens when they need to take advantage of that insurance coverage? Who do you think pays then? I won’t name names, but their initials are t-h-e A-m-e-r-i-c-a-n t-a-x-p-a-y-e-r

But it gets better still:

When we look at all of this evidence, it seems that health reform leaves in place the status quo on illegal immigration, and certainly does not provide any new benefits particularly for illegal immigrants.

“…particularly for illegal immigrants” as in written specifically for them? That’s not what we’re talking about.

First of all, if HR 3200 only left in place that status quo, that alone would be unacceptable. But if we are in agreement that the lack of any form of citizenship verification requirements in HR3200 would allow illegals access to the system - and we are - then it would also allow them access to ‘affordability credits’, ie taxpayer-subsidized health insurance. That, Ms Holan, IS a new benefit, one that doesn’t currently exist for the illegals in this country.

FAIR Action Alert - Call Your Senators NOW

Support American Jobs — Call Your Senators NOW And Urge Them to Support the Grassley Amendment!

Yesterday, true immigration reformers won two crucial legislative victories!

During debate on the Fiscal Year (FY) 2010 Department of Homeland Security (DHS) spending bill, the U.S. Senate adopted two crucial amendments.  The first amendment, offered by Senator Jim DeMint (R-SC), requires DHS to complete all 700 miles of the border fence by the end of 2010 so that it will not just stop illegal alien vehicle traffic but also pedestrian traffic.  The second amendment, offered by Senator Jeff Sessions (R-AL), will protect American jobs by making E-Verify, the program that allows employers to ensure that they hire legal American workers, permanent.  The Sessions Amendment also requires employers who do business with the federal government to use the program.

E-Verify is a great tool for America’s employers.  While the Sessions Amendment is a great victory for people who want to protect American jobs, there is another amendment, offered by Senator Chuck Grassley (R-IA), that the Senate may consider today that would build on yesterday’s victory.

E-Verify only allows employers to check the work authorization status of new hires but not current employees.  Illegal aliens who currently hold jobs they never should have had can continue in those jobs because their employer, who may have unknowingly hired that illegal alien in the past, cannot use E-Verify today to ensure that they employ only legal workers.  Senator Charles Grassley (R-IA) has offered an amendment that would, for the first time, allow employers to use E-Verify to check work eligibility for all their employees — not just new hires.

With unemployment now at a 25-year high, the Grassley Amendment would act as a true stimulus plan for unemployed Americans! If an employer discovers illegal aliens on his payroll, that employer can free up jobs for Americans who are out of work!

Unfortunately, FAIR has learned that Senate Majority Leader Harry Reid (D-NV) may attempt to block the Senate from voting on the Grassley Amendment.  Late last night, Reid filed a cloture motion.  This motion will block all further debate on the bill and would block votes on any more amendments.  This means the Senate could pass the DHS bill without even allowing a vote on the Grassley Amendment!

Blocking a vote on this amendment would represent nothing more than pandering to the special interests who do not want our immigration laws enforced. Even well-known amnesty advocate and chair of the Senate Immigration Subcommittee Chuck Schumer (D-NY) said yesterday on the Senate floor that E-Verify “probably should” be used to verify the work authorization status of existing employees!  That is exactly what the Grassley Amendment would do.

We need your help!! Here’s what you can do to help FAIR pass the Grassley Amendment and open up illegally-held jobs for American Workers:

  1. Call your Senators, and tell them to support the Grassley E-Verify Amendment. (Click here to find your Senators’ telephone numbers.)
  2. Urge the Senate to oppose cloture until Senator Grassley gets a vote on his amendment!
    With nearly 15 million Americans out of work — and with more than 8 million illegal aliens holding jobs in the United States — the least Reid can do is allow for an up-or-down vote on this crucial measure!
  3. Call Senate Majority Leader Harry Reid at (202)-224-3542. Tell him that it’s unfair that illegal aliens can continue to hold jobs while so many Americans are hurting. Urge Reid to ignore special interests and allow the Senate to vote on the Grassley Amendment!

Senate Rejects Vitter Amendment to Prevent Terrorists, Illegal Aliens from Getting Credit Cards

Last week, during debate over a bill to regulate the credit card industry, Senator David Vitter (R-LA) offered an amendment (Amendment #1066) that would have established new rules with respect to how banks issue credit cards. (Vitter Press Release, May 13, 2009). The amendment would have required that banks verify the identification of any person who is not a citizen or national of the United States before they were permitted to open a credit card account. In addition to preventing the ability of illegal aliens to obtain credit cards, Senator Vitter’s press release stated the amendment “would have also closed the loophole that allowed the September 11, 2001 hijackers to obtain credit cards from United States banks to finance their terrorist activities.” (Id.).

Last Thursday, May 14, Senator Dianne Feinstein (D-CA) and Representative Adam Putnam (R-FL) reintroduced the Agricultural Job Opportunities, Benefits and Security (AgJOBS) Act. AgJOBS would grant amnesty to at least 2 million illegal alien agricultural workers and “reform” the H-2A temporary agricultural worker program to allow employers easier access to cheap foreign labor. While actual text of the bill hasn’t yet been made public, it appears that the bill will be equivalent to versions Congress has debated in the past. Lawmakers Question Napolitano on Homeland Security Budget Request

Department of Homeland Security (DHS) Secretary Janet Napolitano appeared before four separate Congressional committees last week to explain the Obama Administration’s $55.1 billion Homeland Security budget request for Fiscal Year (FY) 2010. Legislators in both the House and the Senate questioned Napolitano extensively on how the Obama Administration plans to enforce border security and immigration laws, setting the stage for contentious battles over these issues as Congress moves forward with the appropriations process in the coming weeks. Outlining the president’s budget request, Napolitano highlighted “five main action areas,” including two related directly to immigration: “Securing Our Borders” and “Smart and Tough Enforcement of Immigration Laws.” (See Napolitano’s Statement before the House Appropriations Homeland Security Subcommittee, May 12, 2009).

Error Allows International Fugitive Into the U.S.

Customs and Border Patrol (CBP) officials revealed last week that they may have accidentally allowed an international fugitive into the country last week, despite the fact that he was suspected of alleged rape, armed robbery and illegal possession of a weapon. According to court documents obtained by FOX News, immigration officers fingerprinted a man who flew into J.F.K. International Airport in New York City in early April, resulting in a possible match to a man named Frank Dwomoh. Dwomoh has been on Interpol’s “Wanted Person Lookout” list for crimes in Italy dating back ten years. According to the FOX News report, the man was allowed to enter the U.S. “due to limited information about the Interpol Lookout at that time.” (FOX News, May 11, 2009).

House Appropriations Committee Rejects Border Security, E-Verify Amendments

During a markup of the Fiscal Year (FY) 2009 supplemental spending bill, the House Appropriations Committee last Thursday rejected two amendments that sought to enhance border security and protect American jobs. The first amendment, offered by Homeland Security Subcommittee Ranking Member Hal Rogers (R-KY), contained several provisions aimed at strengthening the integrity of the U.S.-Mexico border. Additionally, Rep. Jack Kingston (R-GA) offered an amendment that would prevent jobs created by the supplemental from being taken by illegal aliens. Napolitano Endorses DREAM Act; Dodges Questions about “Comprehensive” Immigration Reform

Testifying before the Senate Judiciary Committee last week, Homeland Security Secretary Janet Napolitano endorsed the DREAM Act but altogether avoided making a public statement about legislation to enact what amnesty advocates call “comprehensive” immigration reform. The hearing, the first in which Senator Jeff Sessions (R-AL) presided as ranking member, was held as part of the Committee’s oversight authority over the Department of Homeland Security. For over two hours, members of the Committee asked Napolitano about the DREAM Act, “comprehensive” immigration reform, E-Verify, and a host of other immigration and security-related issues

Supreme Court Rules on Identity Theft Case in Flores-Figueroa

Last week, the U.S. Supreme Court overturned the conviction of an illegal alien who was convicted on charges of identity theft and sentenced to two additional years as a result. (See FAIR Legislative Update, February 9, 2009). The case, Flores-Figueroa v. United States, involved an illegal alien who, in order to gain employment at a steel company, provided a false name and date of birth together with a fraudulent alien identification number and Social Security number which had never been assigned to a real person. In 2006, Mr. Flores-Figueroa told his employer that he wanted to be known by his true name and wanted to change the Social Security and alien registration numbers on file for him. He then presented his employer with a Social Security number and an alien registration number that were not his but which the government had assigned to other people. His employer became suspicious and contacted federal authorities. (See Government Brief).

Obama Administration Releases Budget; Immigration Programs Affected

Last week, the Obama Administration released the details of its Fiscal Year (FY) 2010 budget request. The numbers suggest the Administration intends to realign enforcement priorities, by increasing funding in some crucial areas and cutting funding in others. Immigration programs impacted by the budget include: E-Verify; 287(g); the prioritization of aliens who are to be removed from the United States; the State Criminal Alien Assistance Program (SCAAP); and border security.

Study Finds Porous Border Poses Significant Terrorist Threat

A report by the Federal Bureau of Investigation (FBI) and a separate academic study conclude that the points of entry along the U.S. border and unsecured porous border continue to pose a threat from terrorists who may seek to exploit border security weaknesses.  They also serve as a reminder that significant changes are needed to address this risk.
